ANNEX D

1. Justification for the choice of the negotiated procedure without prior publication of a call for competition in accordance with Article 32 of Directive 2014/24/EU

No tenders or no suitable tenders/requests to participate in response to: Not Provided

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the directive: Yes

Additional deliveries by the original supplier ordered under the strict conditions stated in the directive: No

New works/services, constituting a repetition of existing works/services and ordered in accordance with the strict conditions stated in the directive: No

3. Explanation
Due to COVID-19, the planned lighthouse painting works as advertised through the new Dynamic Purchasing System were either cancelled or postponed. The Dynamic Purchasing System, as advertised in OJEU at 2020/S 002-001839, is in its first year and has not yet completed the first Stage 2 competitive process with all registered suppliers. The COVID-19 crisis was unforeseeable and has interrupted planned and advertised procurement activities, resulting in short-term direct award processes to be undertaken to mitigate the situation.
The Direct Award procedure via Public Contracts Regulations Clause 32 (2)(b)(ii) has been enacted to award the repainting works of lighthouses to pre-qualified organisations known to Trinity House, without further competition. The competition is absent for technical reasons, due to accessibility, scaling, expertise and other reasons established by Trinity House. Also, due to COVID-19, site visits were unable to be held with the DPS field of tenderers to gain competitive pricing, as is a requirement for the mini-competitions under the DPS. As per the published DPS documents, attendance at site is mandatory for the mini-competition stage. Trinity House have undertaken and recorded internal processes to establish this revised list of lighthouse sites for works and have contracted with parties established from previous framework agreements for this requirement.
The following lighthouses have had various works awarded under this requirement: Strumble Head, St Ann's, St Anthony, Whitby, Port Lynas, Cromer, Lowestoft, St Catherine's and Nash Point.
It is Trinity House's intention to resume to Dynamic Purchasing System to advertise future requirements when it is both suitable and possible in light of the current operating environment.
